1. Acceptance of Terms

By accessing or using Zeno ("the App"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and France Paul Pastrana ("we," "us," or "our").

If you do not agree to these Terms, you must immediately discontinue use of the App and uninstall it from your device.

We reserve the right to modify these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Description of the App

Zeno is a mobile wellness application designed to provide anxiety relief tools, breathing exercises, mindfulness techniques, and emotional regulation support. Features include:

Guided breathing exercises (4-7-8, box breathing)
Anxiety relief panic button with affirmations
Mindfulness exercises (Crush Anxiety, Burn Bad Thoughts, Untangle)
Motivational quotes and positive affirmations
Session tracking and personal trend reports
Premium subscription features (Zeno Premium)

Some features are free; others require an active Zeno Premium subscription. We reserve the right to modify, add, or remove features at any time.

3. Medical & Mental Health Disclaimer

IMPORTANT: Zeno is intended for general wellness and self-help purposes only.

Zeno is not a substitute for professional medical advice, diagnosis, or treatment.
Zeno is not a licensed mental health service and does not constitute therapy, counseling, or psychiatry.
The exercises and content are based on generally accepted wellness practices but are not guaranteed to produce specific results.
If you are experiencing a mental health crisis or thoughts of self-harm, contact emergency services (911) immediately or call the National Suicide Prevention Lifeline at 988.

Always seek the advice of a qualified healthcare provider with any questions about a medical or mental health condition.

4. Eligibility & Account

To use Zeno, you must:

Be at least 13 years of age
Be at least 18 years of age to purchase a subscription (or have parental consent if between 13 and 17)
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the App under applicable law

Zeno does not require account creation. Your app data is stored locally on your device.

5. Subscriptions & Billing

Billing Subscriptions are billed through your Apple ID account upon confirmation of purchase.

Auto-renewal Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.

Cancellation Cancel at any time through your Apple ID account settings under Subscriptions. Cancellation takes effect at the end of the current billing period.

Refunds All purchases are final and non-refundable except as required by law or Apple's refund policies. Refund requests must be submitted to Apple directly.

Free Trials If a free trial is offered, it will be clearly disclosed prior to purchase. Unused portions of a free trial are forfeited upon purchase of a subscription.

Price Changes We reserve the right to change subscription pricing with advance notice. Continued use after a price change constitutes acceptance.

Restore Purchases You may restore a previous purchase using the "Restore Purchases" option in the Settings screen.

6. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of these Terms
Attempt to reverse engineer, decompile, or disassemble the App
Modify, adapt, or create derivative works from the App
Reproduce, duplicate, copy, sell, or exploit any portion of the App without express written permission
Circumvent any subscription verification or access control mechanisms
Introduce viruses, malware, or other harmful code into the App

7. Intellectual Property

All content, design, graphics, animations, text, sound, and code within Zeno are the exclusive property of France Paul Pastrana and are protected by copyright, trademark, and other applicable intellectual property laws. This includes the Zeno name, logo, brand identity, all written content, visual design, animations, and source code.

Nothing in these Terms grants you any right, title, or interest in or to the App or its content beyond the limited license described herein.

8. Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

Download and install the App on your personal iOS device
Use the App for your personal, non-commercial wellness purposes

This license terminates automatically if you violate any of these Terms.

9. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

Implied warranties of merchantability or fitness for a particular purpose
Warranties that the App will be uninterrupted, error-free, or secure
Warranties regarding the accuracy, reliability, or completeness of any content
Warranties that the App will meet your specific wellness or mental health needs

10. Limitation of Liability

To the maximum extent permitted by applicable law, France Paul Pastrana shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $10.00 USD, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless France Paul Pastrana and its affiliates from and against any claims, liabilities, damages, losses, costs, or fees arising out of or relating to your violation of these Terms, your use or misuse of the App, or your violation of any third-party rights.

12. Third-Party Services

Apple App Store: Handles all payment processing and subscription management. Subject to Apple's Terms of Service.
RevenueCat: Manages subscription entitlements and purchase verification. Subject to RevenueCat's Terms of Service.

We are not responsible for the practices, content, or availability of third-party services.

13. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, including for violations of these Terms. You may terminate your use of the App at any time by uninstalling it from your device.

14. Governing Law & Disputes

These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute shall first be attempted to be resolved through good-faith negotiation, then through binding arbitration in accordance with the American Arbitration Association's rules, conducted in California.

You waive any right to participate in a class action lawsuit or class-wide arbitration against us.

15. Severability & Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App.

16. Apple-Specific Terms

These Terms are between you and France Paul Pastrana only — not with Apple, Inc. Apple is not responsible for the App or its content.
Apple has no obligation to provide any maintenance or support services for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
Apple is not responsible for addressing any claims by you or third parties relating to the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
